Free Business Technology Assessment Terms and Conditions
These Terms and Conditions (“Terms”) govern your participation in the Free Business Technology Assessment offered by imNext, LLC (“imNext”, “we”, “us”, or “our”).
1. Eligibility
To request the Free Business Technology Assessment, you must be a representative of a business or organization. You represent that the information you provide is accurate and that you have the authority to submit the request on behalf of your organization.
2. What the Assessment Includes
The Free Business Technology Assessment is designed to help identify opportunities to improve your business technology and operations. The assessment may include, based on availability and the information you provide:
- a review of your current systems and processes
- discovery questions about tools, workflows, and business needs
- high-level findings and recommendations
- and a proposed next step (if applicable)
We do not guarantee specific outcomes or results from the Free Business Technology Assessment.
3. No Obligation
The Free Business Technology Assessment is not an offer for services, subscription, or contract. Participation does not create an obligation for either party to enter into a paid engagement. If we propose a paid engagement, it will be subject to a separate written agreement.
4. Information You Provide
You agree that any information you submit (including business details, technology details, and any descriptions of problems) will be provided voluntarily and to the best of your knowledge. You are responsible for the accuracy and completeness of the information.
You agree that any recommendations provided are based on the information you share and may be limited by what we can access or infer from your responses.
5. Scheduling and Communication
When you request an assessment, we may contact you to confirm scheduling details and to gather additional information. You agree to provide timely responses to scheduling and intake questions.
If you do not respond within a reasonable time, we may reschedule or close the request.
6. Privacy and Data Handling
Any personal information you submit will be handled in accordance with our Privacy Policy. By submitting your request, you consent to the processing of your information for the purpose of providing the assessment and follow-up communication.
7. No Confidentiality Guarantee for Unshared Information
Although we will make reasonable efforts to protect information you share, the Free Business Technology Assessment is provided without a separate confidentiality agreement unless otherwise agreed in writing. If you require confidentiality beyond what is described in our general policies, please contact us before sharing sensitive information.
8. Third-Party Services and Dependencies
If your recommendations depend on third-party tools, services, or vendor capabilities, you understand that performance, availability, and changes to those third parties are outside our control.
9. Limitations of Liability
To the maximum extent permitted by law, imNext will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or business opportunities arising out of or relating to the Free Business Technology Assessment, even if advised of the possibility of such damages.
10. Disclaimer of Warranties
The Free Business Technology Assessment is provided “as is” and “as available.” We make no warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
11. Changes to Terms
We may update these Terms from time to time. The version posted at the time you submit your request governs your participation.
12. Termination
We may refuse service or discontinue providing the Free Business Technology Assessment at any time if we believe the request is fraudulent, abusive, or otherwise violates these Terms.
13. Governing Law
These Terms are governed by the laws of the State of California, without regard to conflict of laws principles.
